Terms of Service

PLEASE READ THESE TERMS CAREFULLY. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and DaemonData ("the Company," "we," "us," or "our"), a sole proprietorship headquartered in Vancouver, British Columbia.

By accessing or using daemondata.dev (the "Service"), you acknowledge that you have read, understood, and agreed to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM USING THE SERVICE.

1. NATURE OF SERVICE AND ROLE OF DAEMONDATA

1.1 Information Retrieval Tool Only

The Service is designed strictly as a technical utility to assist Users in locating, aggregating, and processing publicly available data from third-party platforms (primarily Reddit). DaemonData provides a conduit for information discovery; it does not generate original financial analysis or market mandates.

1.2 No Responsibility for Information Accuracy

DaemonData does not verify, curate, or guarantee the truthfulness of the data retrieved. You acknowledge that the data presented is sourced from third parties and processed by probabilistic AI models which are prone to "hallucinations" and errors.

2. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS.

2.1 Absolute Disclaimer

DaemonData expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • The implied warranties of merchantability or fitness for a particular purpose.
  • Any warranty that the data provided is accurate, complete, reliable, or timely.
  • Any warranty that the Service will be uninterrupted, secure, or error-free.
  • Any warranty regarding the quality or reliability of outputs generated by third-party LLMs.

2.2 User’s Own Risk

Any data, insights, or notifications received through the Service are accessed at your own discretion and risk. You are solely responsible for any damage to your computer system or loss of data that results from the use of the Service.

3. NO FINANCIAL ADVICE & ASSUMPTION OF RISK

3.1 No Fiduciary Relationship

DaemonData is not a financial advisor, investment broker, or tax professional. No part of the Service constitutes investment, legal, or tax advice.

3.2 Sole Decision-Making Authority

The Service is intended solely to help you find data more easily. Any financial decisions, trades, or investments made by you based on data collected, presented, or processed by the Service are solely your own decisions. DaemonData bears no fault and no liability for any financial outcomes, including total loss of capital, resulting from your use of the data.

The presentation of data (e.g., sentiment graphs or alerts) does not constitute an endorsement or a recommendation.

3.3 Indemnification

You agree to indemnify and hold harmless DaemonData and its owner from any claims, losses, or damages (including legal fees) arising from your reliance on the Service to conduct financial transactions or your violation of these Terms.

4. SUBSCRIPTIONS & AI CREDITS

4.1 Nature of AI Credits

The Service uses "AI Credits" as a metric for service usage.

  • No Cash Value: AI Credits are not currency, property, or "prepaid purchase cards" as defined by the Business Practices and Consumer Protection Act. They are a limited license to access specific processing features.
  • Monthly Allowance: Credits provided via subscription expire at the end of the billing cycle and do not roll over.
  • Supplementary Credits: Credits purchased as "Top-Ups" remain in the account until consumed or until the account/Service is terminated.

4.2 Refund Policy

Fees are non-refundable once the first AI Credit of a billing cycle has been used. Statutory rights for BC residents remain as provided by law and cannot be waived.

5. CESSATION OF SERVICE & TERMINATION

5.1 Right to Cease Services

DaemonData reserves the absolute right to cease operations or terminate the Service at any moment, for any reason, without prior warning.

5.2 Effect of Shutdown

In the event that DaemonData permanently ceases services:

  • Refunds: Active paid subscribers will receive a refund of their current month’s subscription fee in full as their sole and exclusive remedy.
  • Forfeiture of Data: Upon cessation, all User-configured "Service Logic," historical data, graphs, and settings are immediately and permanently forfeit. DaemonData is under no obligation to provide data exports or backups.

6. LIMITATION OF LIABILITY

6.1 Sole Proprietorship Limitation

You acknowledge that the Service is operated as a sole proprietorship. Any legal recourse is strictly limited to the business assets of DaemonData. You expressly waive any right to pursue the personal assets of the owner.

6.2 Liability Cap

To the extent permitted by law, DaemonData’s total liability for any claim shall not exceed the amount you paid to the Company in the three (3) months preceding the claim, or $100.00 CAD, whichever is greater.

7. INTELLECTUAL PROPERTY

7.1 Service Logic

You grant DaemonData an irrevocable, perpetual, royalty-free license to use and commercialize any anonymized configurations or "Service Logic" created on the platform to improve the Service.

7.2 Outputs

You own the outputs generated by the Service. However, DaemonData makes no claim that such outputs are copyrightable under Canadian law, as they are generated by non-human AI.

8. GOVERNING LAW

These Terms are governed by the laws of British Columbia and the laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Vancouver, British Columbia, including the Civil Resolution Tribunal (CRT) where applicable.
